1. Acceptance of Terms
By accessing and using WhatzAI CRM, you accept and agree to be bound by the terms and provisions of this agreement.
2. Service Availability & System Failures
We strive to ensure the highest uptime possible; however, the system may occasionally fail, experience downtime, or undergo maintenance without prior notice or advice. We are not liable for any business losses, loss of data, missed messages, or damages resulting from service interruptions, technical issues, or third-party API changes (e.g., Meta/WhatsApp, AI providers).
3. User Responsibilities & Acceptable Use
You are entirely responsible for how you use the system. You agree to use the platform in compliance with all applicable laws and third-party policies, including WhatsApp's Business Messaging Policies. You must not use the platform to send spam, unsolicited messages, or malicious content. You are responsible for ensuring you have explicit permission (opt-in) from your contacts before messaging them.
Team Members & Workspace Management: If you are the creator or manager of a workspace, you are fully responsible for all actions taken by the team members you invite. This includes ensuring your team members comply with these terms, do not abuse the system, and handle customer data appropriately. You are responsible for managing their permissions and revoking access when necessary.
4. Data Controller Relationship
For the purposes of data protection laws, you (the user) are the Data Controller of your customers' data. We act solely as a Data Processor. You are responsible for managing your customers' data compliantly and handling their privacy requests.
5. Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine that you or your team members have violated these terms, generated excessive spam reports, or abused our API or services.
6. WhatsApp Instances and Connectivity
You may connect your own WhatsApp numbers to the platform using either WhatsApp Web or the Official Meta Business API. You are solely responsible for maintaining the authorization and standing of these phone numbers with WhatsApp/Meta. We do not guarantee uninterrupted connectivity to these instances, as they depend on Meta's infrastructure, your device's connection (for Web instances), and your adherence to WhatsApp policies.
7. Third-Party Integrations
Our service relies on integrations with third-party providers (e.g., Meta, OpenAI, Stripe). We are not responsible for the availability, changes, or limitations imposed by these third-party services.
